Scope of Practice
David Brewster, one of Horizon Law Group LLP’s founding partners, focuses his practice primarily in the areas of business, commercial and general civil litigation and insurance defense litigation. Formerly of Sedgwick, Detert, Moran & Arnold LLP, an American Lawyer Top 150, international litigation firm, Mr. Brewster has extensive trial experience representing large company clients in both defending and prosecuting claims. Mr. Brewster also has substantial experience in representing clients with a variety of corporate litigation matters in the areas of securities law, corporate formation and separation, and stock fraud. Mr. Brewster has experience representing clients in employment and contract related matters, as well as defending against consumer rights claims. He practices regularly in both State and Federal court.
Representative Matters
Mr. Brewster currently represents clients in a variety of matters set for trial ranging from pursuit of a former employee for embezzlement to enforcing owner/shareholder’s rights under a stock purchase agreement. In his most recent trial, Mr. Brewster obtained a defense jury verdict and an award of over $500,000 in attorney’s fees and costs in favor of an international franchisor against claims brought by one of its licensee’s franchisees claiming fraud, negligent misrepresentation, breach of contract and violations of the California Franchise Investment Law. His other victories at trial also include a matter where he obtained a judgment in excess of $100,000 on behalf of a sub-contractor against a developer for non-payment of contract monies due, where the developer had cross-claimed against Mr. Brewster’s client for over $700,000 in damages. Mr. Brewster also achieved a major defense victory by limiting the verdict to $97,000 in a case where a food manufacturer had abandoned the manufacturing facility with over two years remaining on the commercial lease for the building and as a result, had been sued for over $1,000,000 in damages under the commercial real estate lease and for alleged physical damage to the property.
Affiliations, Activities and Accomplishments
Mr. Brewster is admitted to the California Bar (1997). He is admitted to the U. S. District Court for the State of California, Southern, Central and Eastern Divisions. He is also member of the Order of Barristers.
Education
Mr. Brewster earned his B.A (1992) in Sociology from the University of California, Davis. He earned his J.D. (1997) from the University of San Diego School of Law. Upon graduation from law school, he was awarded the Dean's Award for Distinguished Service and the Statue of Justice Award for Excellence in Oral Advocacy. Mr. Brewster also served as the Chair of the Appellate Moot Court Board while in law school and was a member of the Jessup International Moot Court Competition team.
